and furthermore at this court it is shown by the homage that Robt Crowe senior who held for himself and his heirs one customary messuage with garden with appurtenances lately in the occupation of Rich Brock and now in the tenure of Arth Fuller called The Smiths Forge lying in Earls Colne who surrendered to the lord before this court the aforesaid messuage and garden with appurtenances to the use and intention of his last will as by a court roll bearing the date 3.1.1637 plainly appears after the last court died thus seised thereof upon which came here into court Robt Crowe junior son of the said Robt Crowe and produced here in court testimonial letters of the said Robt Crowe proved under the seal of the ordinary for this area bearing the date 22.2.1640 by which the aforesaid Robt Crowe senior gave and bequeathed the aforesaid messuage and garden with appurtenances to the aforesaid Robt Crowe son and heir and his assigns forever upon the condition that the aforesaid Robt Crowe his heirs or assigns should pay or cause to be paid to Ann Crowe daughter of the said Robt Crowe senior annually by three annual payments following the death of the said Robt senior 10s of legal money of England upon the condition that the aforesaid Robt Crowe his heirs or assigns should pay or cause to be paid to the aforesaid Ann Crowe or her assigns 20li of legal money of England within three years next following the death of the said Robt Crowe senior at a certain place mentioned in the aforesaid testimonial letters and upon the further condition that the aforesaid Robt Crowe his heirs or assigns should pay or cause to be paid to Giles Crowe his brother or his assigns 20li of legal money of England at a certain date and place mentioned in the aforesaid testimonial letters as by the aforesaid testimonial letters it plainly appears upon which the aforesaid Robt Crowe humbly sought admittance to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid messuage and garden with appurtenances to the aforesaid Robt Crowe his heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and he gave to the lord for a fine and made fealty and was admitted thereof tenant upon the aforesaid conditions
