surrender in mortgage | and furthermore at this court it was shown by the homage that Thos Smith of Brafen in the county of Herts yeoman after the last court viz 25.9.1640 surrendered into the hands of the lord by the hands of Wm Adams instead of the bailiff in the presence of Hen Ennewe and Jas Pennock two customary tenants of the aforesaid manor the same testifying according to the custom of the aforesaid manor all that his messuage in White Colne with all the buildings gardens orchards and appurtenances pertaining to the same and all those lands meadows and pastures called Loshes and Foulmeade in the aforesaid White Colne and in the occupation of Hen Cooke or his assigns to the use and behoof of Wm Ennewe of Coggeshall Magna his heirs and assigns forever upon the condition that if the aforesaid Thos Smith his heirs executors or assigns should pay or cause to be paid to the aforesaid Wm Ennewe his heirs executors or assigns 162li of legal money of England in or upon 26.9.1641 at the dwelling house of the said Wm Ennewe in Coggeshall Magna aforesaid that then the aforesaid surrender should be void and of no force |
