and furthermore whereas at a court here held 5.6.1628 Thos Smith senior was admitted tenant of the lord for himself and his heirs to one tenement or cottage and garden with appurtenances lying in Earls Colne as by a roll of the aforesaid court it appears now at this court it is shown by the homage that after the last said court the said Thos Smith died thus seised thereof and that Agnes Smith Jane Smith Edith Smith Grace Smith and Eliz Smith are the blood relatives and coheirs under age viz sisters (error for daughters) and coheirs of Thos Smith now deceased the only son of the said Thos Smith senior who by Agnes Smith their mother and deputy humbly sought admittance to whom by their mother and aforesaid deputy the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid cottage and garden with appurtenances to the aforesaid Agnes Jane Edith Grace and Eliz their heirs and assigns forever from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs there unto belonging and by right accustomed and they gave the lord for a fine and because they are under age as above therefore custody of their bodies and the aforesaid tenement was committed by the lord to the aforesaid Agnes Smith their mother until the aforesaid daughters should reach their separate ages of twenty one years finding them food and clothing and other necessaries and returning thereof the accounts and for such custody she gave to the lord for a fine
