whereas at a court here held 18.5.1630 Mary Church was admitted tenant of the lord for herself and her heirs to all that messuage or customary tenement called Clarkes and five crofts or parcels of land lying on the backside of the aforesaid messuage and whereas the aforesaid Mary by another roll was then admitted to the croft of customary land called Catescrofte with appurtenances as by the two copies of the rolls of the aforesaid court it appears now at this court it is shown by the homage that the aforesaid Mary Church after the last court viz 1.6.last surrendered into the hands (omitted) by the hands of Robt Johnson bailiff of the aforesaid manor and in the presence of Edw Elliston gentleman and Robt Crowe two customary tenants of the aforesaid manor the same testifying etc the aforesaid messuage and five crofts of land with appurtenances and the aforesaid croft of land called Catescrofte among others by name all her lands and customary tenements held of the aforesaid manor to the use and intention of her last will and testament and furthermore it is shown by the homage that the aforesaid Mary Church made her testament and last will in writing bearing the date 17.5.last and that the tenor concerning the premises in the following english words item I give and bequeath to Rose Church my loving mother all that my copyhold messuage and tenement called Clarkes and five parcels of land thereunto belonging and one other parcel of copyhold land called Catescroft or by whatever other name or names the same or any part or parcel thereof now are or at any time heretofore have been called situate lying and being in Earls Colne aforesaid holden of the manor of Colne Priory and now in the tenure and occupation of Hen Thompson or his assigns for and during the full term of her natural life and after her decease I give the same to Ralph Josselin of Earls Colne aforesaid clerk and to his heirs and assigns forever upon these conditions hereafter following viz that he the said Ralph Josselin his heirs executors administrators or assigns shall pay to the said Rose Church the sum of 30li of good and lawful english money at before or upon the next general court day that shall next ensue for the manor of Colne Priory after my death and also upon condition that the said Ralph Josselin his heirs executors administrators or assigns shall pay unto the said Rose Church my mother the sum of 20li more of like lawful money of England within six months next ensuing after the said court and 5li more unto the poor people of the said parish upon the day of my burial or within two days after at the discretion of the said Rose Church and Ralph Josselin and also upon condition that the said Ralph Josselin his heirs executors administrators or assigns shall pay unto Jane Josselin his daughter the sum of 100li of current money of England so soon as she shall attain her age of twenty one years provided that if she shall happen to die before then to remain to the said Ralph Josselin his heirs and assigns as by the aforesaid testament signed by the hand and signature of the said Mary and sealed and here in court produced it appears and afterwards and before this aforesaid court the aforesaid Mary died thereof seised upon which came here into court the aforesaid Rose Church and Ralph Josselin and humbly sought admittance to the aforesaid messuage called Clarkes the aforesaid five crofts of land lying on the backside of the said messuage and to the said croft of land called Catescroft with appurtenances according to the tenor of the aforesaid testament to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid messuage and five crofts of land and the aforesaid croft of land called Catescroft with appurtenances to the aforesaid Rose Church and her assigns for her lifetime the remainder thereof after her decease to the said Ralph Josselin his heirs and assigns upon the conditions mentioned and specified in the aforesaid testament from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord separately for their fines and were admitted thereof tenants and they made fealty to the lord
