admission of Ann Burton widow and Sam Burton to one messuage | whereas at a court here held 3.10.13Chas1 Sam Burton took for himself and his heirs by copy of a court roll one messuage or tenement and garden adjoining with appurtenances sometime of Wm Waite and whereas at a court here held 19.10.1659 it was presented by the homage that after the then last court viz 8.10.1659 the aforesaid Sam Burton surrendered into the hands of the lord by the hands of Jn Clerke instead of the bailiff and in the presence of Geo Cressner gentleman and Jn Brewer two customary tenants of the aforesaid manor the same testifying the aforesaid messuage or tenement and garden with appurtenances then in the tenure and occupation of the said Sam to the uses and intentions mentioned in his last will and testament now at this court it is shown by the homage that the aforesaid Sam Burton after the last court died thus seised thereof upon which came here into court Ann Burton widow late wife of the same Sam Burton and Sam Burton son of the said Sam and produced here in court the last will and testament of the said Sam as they say in writing bearing the date of the said 8.10.1659 the tenor of which concerning the premises in the following english words item I give and bequeath to my loving wife Ann all that my copyhold messuage or tenement wherein I now dwell together with the yards backsides and all their and every of their appurtenances to the same belonging for and during the term of her natural life and after her decease I give the same to my son Sam and his heirs as by the aforesaid testament and last will it plainly appears and upon this the aforesaid Ann Burton and Sam Burton the son humbly sought admittance as tenants of the premises according to the tenor and effect of the aforesaid testament and last will to whom the same said Ann and Sam the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid messuage and other premises with appurtenances to the aforesaid Ann and her assigns for her lifetime and after her decease to the aforesaid Sam Burton the son his heirs and assigns from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord for a fine and thus they were admitted thereof tenants of the lord |
