at a court held 20.10.1659 Eliz Josselin after the wife of Gilb Smith was admitted to one cottage with a yard and a pond belonging lying on the south part of Colne Green and at a court held 31.5.1714 the said Eliz by the name of Eliz Smith widow surrendered all her customary lands etc to the use of her last will now at this court it appeared that she died after the last court upon which came Wm Smith eldest son of the said Eliz and showed her will dated 23.11.1714 the tenor concerning the premises in the following words imprimis I give and devise unto my eldest son Wm Smith and to his heirs forever all that my messuage or tenement and farm with the lands and tenements thereunto belonging with the appurtenances in Earls Colne aforesaid now in the occupation of Thos Stead and all that my cottage with the appurtenances in Earls Colne aforesaid in the occupation of Thos Pudny and Jn Dore and also all that my hopground with the appurtenances in Earls Colne aforesaid in the occupation of my said son Wm upon condition that my said son Wm Smith and his heirs shall and do pay unto my daughter Jane the wife of Jas Robinson or her assigns yearly and every year for and during the term of her natural life the sum of 5li of lawful money of Great Britain the first payment to begin and to be made within one year next after my decease and all sub conditions in the will expressed as plainly appeared and upon this the said Wm Smith was admitted etc and gave fine etc
