to this court came Edw Farthinge and in full court surrendered into the hands of the lord the said two tenements and one garden adjoining the same situated in Church St in Earls Colne called The George as etc to the use and behoof of Roger Goodrich and Alice his wife and the heirs of their bodies between them legitimately procreated who present in court came and sought admittance thereof and they were admitted thereof tenants of the lord to whom by the steward the lord delivered thereof seisin to hold for themselves and the heirs of their bodies between them legitimately procreated from the lord by the rod etc and etc and they made fealty to the lord
fine 5s however this present surrender and seisin thereof was freely made upon the following condition namely that if the said Roger his heirs or assigns should pay or cause to be paid to the aforesaid Edw or his rightful attorney or executors 4li of good and lawful english money a further 4li remaining to be paid on the day of this court held the monday after the holy trinity next following upon the title of this court in the dwelling house of Barth Churche in the said Earls Colne that then this present surrender should remain freely and stand in its force and remain in effect and if there should be default in the payment in any part of the 4li contrary to the said form that then the same said Edw or his assigns should be allowed to repossess and retake the said two tenements and garden with appurtenances and any parcel thereof thus to have to hold to enjoy and to possess as his former estate and the aforesaid Roger his heirs and assigns should be totally expelled there from and removed this present surrender and seisin thereof should not stand in any way
