whereas at a court here held tuesday being 5.9.1587 Rich Parker was admitted tenant of the lord for himself and his heirs to one messuage and 10a of customary land with appurtenances late of Rich Hill and now jointly held called Pakes Gate lying in the said Colne as by a roll of that same court here in court produced and clearly shown now at this court it is shown by the homage that the said Rich Parker died after the last court and before his death surrendered into the hands of the lord by the hands of Hen Clench instead of the bailiff in the presence of Thos Smithe and Robt Crowe two customary tenants of the same testifying according to the custom of the said manor the said premises with their appurtenances to the use and behoof of his will and last testament the tenor of which same testament with regard to the premises in the following english words item I give to Rich Parker my son one tenement and 10a of land more or less lying along against Colne Park called Pakesgate upon this condition that he shall pay to Ann Parker my daughter the sum of 50li of good money etc to be paid 10li a year during the term of five years after my decease within a year after for the first payment and so to pay every year after during the foresaid term and if the said Rich my son shall refuse to pay according to my true meaning the 10li a year that then it shall be lawful for my daughter to enter into the tenement and any part and parcel thereof to have hold and possess unto her use and her assigns during the term of five years fully to be complete and ended as by the said testament produced here in court bearing the date 4.3.1611 and under the seal of the ordinary approved and clearly shown now to this court came the said Rich Parker being under age viz aged 16years or thereabouts and sought for himself admittance to the premises according to the said surrender to whom the lord by his steward granted thereof seisin to have to himself and his heirs to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord his fine as asked etc and was admitted tenant thereof and his fealty was respited and because the aforesaid Rich Parker is under age therefore custody of his body and the said land is committed to Margt Parker his mother to have to herself and her assigns until he reaches the age of 21years then to return to him the profits thereof
