and also at this court it is shown by the homage that after the last court and before this court Sam Bruer surrendered into the hands of the lord of the said manor by the hands of Simon Ive instead of the bailiff in the presence of Edw Cressner and Jeff Potter two customary tenants of the same manor the same testifying according to the custom of the same said manor all that capital messuage with garden and curtilage adjoining the same sometime called Sonningwells with one tenement adjoining called Tabors with appurtenances lying in the said Colne to the sole use and behoof of Jn Potter senior of Colne Engaine his heirs and assigns forever upon the condition however that if the said Sam Brewer his heirs or assigns should pay or cause to be paid to the aforesaid Jn Potter his heirs or assigns the full sum of 90li at or in the south porch of the parish church of the said Earls Colne in or upon the 18.10.==== that then this present surrender should be null and void or otherwise it should remain in full strength and force
