and furthermore it is shown by the homage that Thos Turnor customary tenant of this manor after the last court and before this court viz 17.8.1627 surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Robt Davy and Jn Pennock two customary tenants of the said manor the same witnessing according to the custom of the said manor one barn and stable and cottage lately built and a parcel of a curtilage or yard in Earls Colne to the use and behoof of Jn Potter of Berthall in White Colne and his heirs forever upon the condition that if the said Thos Turnor his heirs executors administrators or assigns should pay or cause to be paid to the said Jn Potter his heirs executors or assigns the sum of 23li15s upon or before 17.8.1628 at or in the dwelling house of the said Jn Potter called Berthall or should give and make any other satisfaction or fulfilment to the said Jn Potter his heirs or executors for the aforesaid sum that then this present surrender should be null and of no force
