and furthermore whereas at a court here held 30.5.1637# Edw Clarke and Wm Brand were admitted tenants of the lord for themselves and their heirs by the surrender of Jane Clench widow and afterwards wife of Jn Elliston gentleman and now deceased to one customary cottage and about 9a of land called Chewneylands upon condition and with the intention that the said Edw Clarke and Wm Brand make such surrender of the premises to such a person or persons as Rich Harlakenden esq lord of the said manor and brother of the said Jane shall limit or nominate as is clearly shown by the said court roll now to this court came the said Edw Clarke and Wm Brand and brought here into court writings by the hand and with the seal of the said Rich Harlakenden signed and sealed bearing the date of the day of this court that the said Rich Harlakenden present in court acknowledged by that the said Rich Harlakenden wished and directed the said Edw and Wm to surrender the said premises between them to the use of Jane Clench and Helen Clench daughters of the said Jane and the heirs of their bodies legitimately procreated and in default of such issue to the use of the heirs of the body of the first Jane Elliston legitimately procreated in full satisfaction and in acquittal of the separate legacies or gifts made to the said Jane and Helen in or by the last will of Hen Clench gentleman deceased their father and in default of such issue to the use of the rightful heirs of the said Jane Elliston forever and on that account the said Edw Clarke and Wm Brand in full court surrendered into the hands of the lord by the hands of the steward the aforesaid cottage and about 9a of land with appurtenances to the use and behoof of the said Jane Clench and Helen Clench and the heirs of their body legitimately procreated and in default of such heirs to the use of the heirs of the body of the said Jane Elliston legitimately procreated in acquittal and satisfaction of the said legacies and gifts and in default of such issue the remainder thereof to the use of the rightful heirs of the said Jane Elliston forever to whom the same Jane and Helen by Edw Clarke their deputy the lord by the said steward granted and delivered seisin by the rod to have and to hold the said cottage and 9a of land with appurtenances to the said Jane Clench and Helen and the heirs of their bodies procreated the remainder thereof as is said above from the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord their fine etc
