whereas at a court here held 3.1.1637 Thos Osborne was admitted tenant of the lord for himself and his heirs to one cottage with garden adjoining with appurtenances called Oldhall and whereas at the said court the said Thos Osborne was admitted to 1r of land parcel of the lord's waste and adjoining the said cottage as is shown by the said court roll now at this court it is shown by the homage that the aforesaid Thos Osborne after the last general court viz 15.5.1645 surrendered into the hands of the lord by the hands of Rich Fisher instead of the bailiff and in the presence of Jn Reade and Barth Clarke two customary tenants of the said manor testifying the said cottage garden and 1r of land with appurtenances to the use and behoof of Francis Turner and Helen his wife and the heirs of their bodies legitimately procreated and in default of such issue to the use of the rightful heirs of the said Francis who present in court humbly sought admittance to whom the lord by the said steward granted and delivered seisin by the rod to have and to hold the said cottage garden and 1r of land with appurtenances to the said Francis Turner and Helen his wife and the heirs of their bodies legitimately procreated the remainder thereof to the rightful heirs of the said Francis from the lord by the rod at the will of the lord according to the custom of the manor by the separate rents and services thereunto belonging and they gave to the lord their fine
