whereas at a court held for the said manor on 11.12.1638 Hen Ennew was admitted tenant to him and his heirs to one messuage with a garden adjoining in Colne St late of Wm Greene and to 4a of land more or less enclosed lying near Hynds Land as the said messuage and premises are situate and being in Earls Colne and whereas at a court held for the said manor 15.1.1650 it was presented by the homage that the said Hen Ennew did upon 23.11.1649 surrender into the hands of the lord of the said manor by the hands of the said Jn Joscelyne steward of the said manor the said messuage lands and premises by the name of all his messuages lands and tenements held by copy of court roll of the said manor to the uses intents and purposes in his last will mentioned and expressed now at this court it was presented by the homage that the said Hen Ennew since the last court died thereof so seised whereupon at this court came Phil Ennew executor of the last will and testament of the said Hen Ennew and Wm Ennew grandchild of the said Hen by the said Phil Ennew his attorney and deputy in that behalf and showed forth in court the last will and testament of the said Hen in writing bearing the date 20.11.1649 the tenor whereof concerning the premises followeth in these words item I give to Wm Ennew my grandchild all those my messuages lands and tenements with every of their appurtenances situate lying and being within the several parishes of Aldham Fordham Earls Colne and Copford by what name or names the same premises or any of them are called and known to have and to hold to the said Wm Ennew my grandchild at his age of twenty three years and to the heirs male of his body lawfully begotten and for default of such issue to Hen Ennew my grandchild and to the heirs male of his body lawfully to be begotten and for want of such issue to the right heirs of Hen my son forever provided always and my will and mind is that until my said grandchildren Hen and Wm shall accomplish their said general ages of twenty three years my executor hereafter named shall receive and take the rents issues and profits of all my said messuages lands and tenements hereby devised to them respectively for and towards the payment of my debts and legacies and towards their education and maintenance and payment of their fines and I devise and do hereby nominate and appoint my executor hereafter named to be guardian to my said grandchildren until they shall attain to their several ages aforementioned and in and to the said will did nominate and appoint the said Phil Ennew sole executor of his said will as by the said will in due form of law proved it doth and may more fully and at large appear and thereupon the said Phil Ennew in his own person and the said Wm by the said Phil his attorney and deputy in that behalf did humbly desire to be admitted to the said messuage and premises to which said Phil in his own person and to the said Wm by the hands of his said deputy the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said messuage garden lands and premises to the said Phil Ennew until the said Wm Ennew shall attain his age of twenty three years to the intents and purposes in the said will mentioned and after the said Wm shall attain his said age of twenty three years to have and to hold the said messuage lands and premises to the said Wm and the heirs male of his body of the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services formerly due and of right accustomed and they gave to the lord for their fine and the said Phil did his fealty
