at this court it was presented by the homage that Edw Browne a customary tenant of the said manor since the last court that is to say upon 29.9.1657 did surrender into the hands of the lord of the said manor by the hands of Wm Roote in place of the bailiff and in the presence of Wm Adams the elder and Barth Clerke two customary tenants of the said manor the same witnessing etc all that customary pightle of land called Wards then in the tenure or occupation of Jn Roote situate in Earls Colne between the garden of Jn Bonner towards the west and the garden sometime of Jn Tilwicke towards the east and south and the common street towards the north to the use of Rich Harvye of Heddingham at Castle husbandman and of his heirs and assigns forever but because after proclamation thrice made according to the custom of the said manor the said Rich Harvye came not to be admitted tenant to the same a precept was made to the bailiff of the said manor to seize the said lands into the lord's hands etc
