at this court it was presented by the homage that Rose Church widow a customary tenant of the said manor since the last court that is to say upon 17.11.1657 did surrender into the hands of the lord of the said manor by the hands of Jn Carter in place of the bailiff and in the presence of Wm Adams and Robt Carter two customary tenants of the said manor the same witnessing amongst other things one piece of land called Spriggs Garden belonging to a freehold messuage called Scriveners otherwise Squires being an orchard and the pond in the same and one other parcel of land sometime parcel of Bearecroft containing by estimation 1a more or less and adjoining to the said Spriggs Garden towards the north to the uses intents and purposes mentioned or to be mentioned in the last will and testament of the said Rose and afterwards and before this court the said Rose died which premises the said Rose did take to her and her heirs at a court held for the said manor 17.5.1631 whereupon at this court came Eliz Webb wife of Wm Webb of Colne Engaine and daughter of Jn Church deceased and showed forth in court the last will and testament of the said Rose in writing bearing date 15.4.1657 the tenor whereof concerning the premises together with other lands is in these words I give and bequeath to Eliz the daughter of Jn Church and now the wife of Wm Webb of Colne Engaine Essex husbandman and to her heirs and assigns forever all my freehold messuage or tenement wherein I now dwell called Scriveners and all and every the houses edifices building barns stables yards gardens and appurtenances to the same belonging etc and also I give and bequeath to the said Eliz and to her heirs and assigns forever all my two pieces or parcels of copyhold land with the appurtenances holden of the manor of Earls Colne one of them being an orchard called Spriggs Garden with a pond in it and adjoining to my before mentioned bequeathed illegible text garden belonging to Scriveners and the other parcel or croft of land being a parcel of Bearecrofts containing by estimation 1a more or less and adjoining both said Spriggs Garden and pond on the part towards the north as by the said will it doth and may appear and thereupon the said Eliz desired to be admitted tenant to the said two pieces or parcels of land to whom the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said parcel of land called Spriggs Garden with the pond in it and the said parcel or croft of land sometimes parcel of Bearcroft with appurtenances to the said Eliz her heirs and assigns forever of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and customs due and the said Wm and Eliz gave to the lord for a fine
