and after Geo Biddulph esq comes here into court in his own person and complains against said Sam Burton in a plea of land to wit one barn one garden 6a of land and 2a pasture with appurtenances in Earls Colne etc and made protestation to prosecute his plaint in form etc of a writ of entry upon a disseisin in le post at common law and prays process etc against said Sam and said Sam present here in court freely appears to answer said plaint and after which said Geo demands against said Sam the said tenement with appurtenances as his right and inheritance etc in which Sam has not entry but after the disseisin which Hugo Hunt thereupon unjustly and with out judgement made to the said Geo within thirty years last past and thereupon says that he himself was seised etc in his demesne as of fee etc and thereupon brings suit etc and the said Sam comes and defends his right etc and vouches thereupon to warranty said Mary Parish who present here in court freely warrants etc after which Geo demands against said Mary tenant by his warranty etc said Mary defends her right and vouches to warranty Andrew Parish who also present freely warrants etc and after said Geo demands against said Andrew etc in said form and says he was seised etc and thereupon brings suit and said Andrew vouches Jn Hatch who present freely warrants etc and after Geo demands against said Jn etc and the said Jn etc comes and defends etc and says that Hugo Hunt did not disseise said Jn of the tenement as by plaint supposes etc and puts himself said Geo prays leave to imparl at four hours after noon of this present day and it is granted and after that hours comes here again said Jn although solemnly demanded does not come etc in contempt of court and made default therefore it is considered that said Geo do recover seisin of the said tenement against Sam Sam to have of the lands and tenements of said Mary to the value etc said Mary to have lastly of the lands of said Andrew to the value etc and said Andrew lastly to have of lands of said Jn to the value etc and said Jn in mercy etc and after said Geo prays precept etc and after the same day Jas Clay the officer of the court as baillie of it returned said precept etc and by virtue caused said Geo to have full seisin etc Geo comes and petitions admitted to said premises according to effect of said recovery
