at this court it was found by homage that on this present 22.4.1740 Oliver Johnson and Abigail his wife customary tenants of the manor did before sitting of court surrender by rod into hand of lord and lady by hand of Solomon Grimston deputy steward she Abigail being first solely and privately examined by deputy steward and consenting etc all that messuage or tenement with buildings and appurtenances belonging called the Hayhouse and several pieces of land pasture and hopground containing 32a more or less and Sladesland containing 8a more or less and 1a land in Longland with all their appurtenances to messuage called Le Hayhouse belonging to use of Sam Smith of Earls Colne surgeon his heirs and assigns forever provided always and upon condition nevertheless that if Oliver Johnson and Abigail his wife or either of them or heirs or assigns of Abigail or any of them shall and do from time to time and at all times hereafter well and sufficiently save and keep harmless and indemnified the said Sam Smith his heirs executors and administrators and also one messuage or tenement with yards gardens and appurtenances in Earls Colne held of manor of Colne Priory now or late purchased by Sam Smith of said Oliver Johnson and Abigail his wife of and from all and every the legacies given and bequeath to any person or persons whatsoever in and by last will of Edw Abbutt deceased and of and from all the debts of Jos Abbutt deceased and of and from all and every legacy and legacies in and by his last will given or bequeathed to any person or persons whosoever and also of and from all charges damages costs and expenses which he or they shall or may sustain incur or be put unto for or by reason of any neglect of failure of payment of any the aforesaid debts or legacies or upon the account of said Sam Smith having purchased the said messuage or tenement lands and premises then this surrender to be void
