whereupon to this court came as well the foresaid Wm Finche the elder as the foresaid Wm Finche the younger and in their proper persons surrendered into the lord's hands by the hands of the steward the foresaid cottage with garden adjoining and the appurtenances called Cloviers to the use and behoof of Thos Turnor his heirs and assigns on condition following viz that the foresaid Thos Turnor or his certain attorney his heirs executors or administrators or some or one of them pay or cause to be paid to the foresaid Wm and Wm Finch or their certain attorneys executors administrators at the dwelling house of the foresaid Wm Finche the elder situate in Colne aforesaid at the feast of michaelmas.next coming after the date of this court 40s of good and lawful money of England and so from year to year 40s at the feast and place aforesaid until the foresaid Thos Turnor his heirs or executors pay or cause to be paid unto the said Wm and Wm Finche their executors or administrators the sum of 18li of good and lawful money of England that then this present seisin thereof delivered shall remain and be in all his force and effect and if there be default in payment of the sum aforesaid contrary to the form aforesaid that then it shall be lawful to the foresaid Wm and Wm Finch the heirs and assigns of the foresaid Wm Finche the younger into the foresaid cottage with the garden adjoining and the appurtenances called Clovyers and every parcel thereof to reenter and have again and so as in their former estate the same to have hold occupy enjoy and possess and the foresaid Thos Turnor his heirs and executors licence thereto being first had to expel and amove this present surrender and seisin thereof delive red in anywise notwithstanding to which Thos Turnor by the lord's steward there is seisin thereof delivered to hold to him his heirs and assigns of the lord by the rod etc on condition aforesaid etc and he giveth fine etc and made fealty
