Thos Garrard complaineth against Jn Garrard of a plea of land viz of one messuage 12a of land 4a of meadow and 10a of pasture with appurtenances in Earls Colne within the jurisdiction of this court and made protestation to prosecute his plea of the writ of our sovereign lady the queen of assize of mort d'ancestor at the common law and prayed process for him to be made according to the custom of this manor in the nature and form of the writ aforesaid to be directed to the bailiff of the manor aforesaid by a warrant and precept of the lord of this manor and according to the custom of this manor may summon by good summons twelve good honest and lawful men of the homage of this manor that they be before the steward of this manor at the next court within this manor to be holden prepared upon their oaths to acknowledge if Jn Garrard the father of the fore said Thos were (sic) seised in his demesne as of fee of the will of the lord according to the custom of the manor in the day when he died of and in one messuage 12a of land 4a of meadow and 10a of pasture of the customary lands of this manor with the appurtenances within the jurisdiction of this court and if the same Jn Garrard the father died within fifty years now last past and if the same Thos Garrard the son be the next heir of the said Jn the father and in the meantime that they may see the lands and tenements aforesaid and that he may summon by good summons the foresaid Jn Garrard that now holdeth the lands and tenements aforesaid to hear the said acknowledgement and he found pledge to prosecute the plea aforesaid Jn Den and Rich Fen
