fine 20s | it is found by the homage that Phil Smithe that held to him and his heirs of the lord by the rod etc one cottage with a garden adjoining and the appurtenances called Litmans as etc as by the copy of court roll here holden on monday being 21.6.10Eliz1 more at large appears died since the last court and before his death lying on his death bed surrendered into the lord's hands by the hands of Wm Fisher and Thos Polley the lord's customary tenants and other the same witnessing the foresaid cottage with the garden adjoining with the appurtenances to the use and behoof of his last will and testament by the which he gave willed and legacied the premises in these english words following item I will give and bequeath unto Margt my wife and her assigns one cottage with a garden adjoining lying and being in Earls Colne called Lytmans until such time as Jn Smythe my son shall come to the age of twenty one years and then I will the said cottage with the garden adjoining and the appurtenances shall remain to the said Jn Smyth my son and his heirs forever as by the said will bearing date 30.8.1580 more at large appears whereupon now to this court came the foresaid Margt the widow of the aforesaid Phil and humbly prayed to be admitted to the premises according to the form and effect of the surrender aforesaid to whom by the lord's steward there was seisin thereof delivered by the rod to have and to hold to the foresaid Margt until the foresaid Jn Smythe the son now of the age of 10mths and no more come unto his age of twenty one years of the lord by the rod etc by the rents and services etc and he (sic) gave fine etc and made fealty and is admitted the lord's tenant |
