to the right honourable sir Thos Egerton knight lord keeper of the great seal of England in most humblewise complaining showeth unto your lordship your poor suppliant Eliz Enos that whereas Rich Enowse of Earls Colne Essex father to your suppliant in or about .7.29Eliz1 for the advancement and preferment of your suppliant did enter into bond of 40li to one Jn Grene of the same town and county yeoman with condition that the executors or administrators of him the said Rich Enowse your suppliant's said father should within two years next after the decease of him your said oratrixes said father pay or cause to be paid to your suppliant the sum of 40li at two several days of payment then the said bond to be void or else to remain in full force and afterwards viz about ten years last the said Rich Enowse your suppliant's said father died and made or appointed Edm Enowse his son brother to your poor suppliant his sole executor which said Edm after the decease of your oratrixes said father took upon him the execution of his goods and chattels and did administer accordingly and so it is right honourable that albeit there came goods and chattels to the hands of the said Edm Enowse as executor to your oratrixes said father sufficient to have paid your oratrix and sufficient to have paid all the debts and legacies with great overplus he the said Jn Grene in whose name the bond was taken to your said oratrixes use and the said Edm Enowse by secret combination betwixt do seek by all means and ways they can to defraud your poor suppliant of the said sum of 20li and the said Edm Enowse doth refuse to pay your suppliant the same 20li albeit he hath been often thereunto required and entreated by your suppliant neither will the said Jn Grene put the said bond of 40li in suit against the said Edm Enowse as executor to his father deceased albeit the money has been due to your suppliant for these eight years last or thereabouts and albeit the said Jn Grene has been earnestly entreated to put the said bond in suit and the common law of this realm so taken in his name to and for the use of your poor suppliant in consideration of all the said premises and for as much as your suppliant hath no remedy by the course of the common laws of this realm to recover or come by the said 20li so given to her as aforesaid by her said father neither by the course of the common laws can compel the said Jn Grene in whose name the bond was taken to your suppliant's use to commence suit upon the said bond of 40li against the said Edm Enowse at the common law as in all right and equity he ought to do it may therefore please your lordship the premises considered to grant to your suppliant her majesty's most gracious writ of subpoena to be directed to the said Jn Grene etc and to be compelled and ordered by this court to put the said bond in suit against the said Edm Enowse at the common law or to permit suffer and also to justify any action your suppliant will bring or commence upon the same bond of 40li in the said Grene's name etc
