twenty that he was present at a trial at the assizes held at Brentwood for the county of Essex between one Thos Prior then complainant and Wm Adams clerk defendant touching the title of certain lands in Earls Colne aforesaid and saith that the cause of the said suit was between the said Prior and Adams was for that the said Adams pulled up certain pales whereupon he was sued upon an action of trespass by the said Prior and also saith that at the same time the said mr Adams brought down another cross suit or nisi prius against the said Prior and the reason wherefore the said cross suit was not then tried was for that the said mr Adams was overthrown in the action of trespass and therefore would not adventure the hearing of the other cross suit and also saith that the said mr Adams at the foresaid trial produced mother Brewer Robt Parker and Parnell Silitoe widow and one Wm Inman and Wm Barnard as witnesses but this deponent now certainly remembreth not whether all or any of the said witnesses were or was there sworn at the said trial for and on the behalf of the said mr Adams or not nor doth he this deponent now remember whether the said Robt Parker was sworn at the said trial on either side or not
