nine that he this deponent in michaelmas term 1622 had some speech with the said Rose concerning the several legacies given to her children by the last will and testament of her said husband Cuckoe at which time this deponent saith that the said Rose acknowledged that her said late husband Cuckoe had by his last will and testament bequeathed unto every one of her children begotten by him the sum of 20li apiece the said children being twelve in number and this deponent demanding further of her how many of her said children were paid the said legacy she answered that there were some three or four paid and the rest were unpaid and then this deponent demanded of the said Rose whether the legacies of the children that were dead did not belong to the children that were living the said Rose answered " no " further saying that as she did take it the legacies of the children dead did belong to her as being the executrix of the last will and testament of her said husband Cuckoe
