to the sixth says that Robt Read and the workmen and carriers of timber and every of them were not at any time stopped to pass through any usual or lawful way or gate to carry the timber by them laden in any cart or carriage as is supposed but says that they did stop them at the gate to this defendant's ground where is no usual causeway but only a way of sufferance but says that there is another way more usual or convenient for their carriage whither they were than was the way by the said gate where this unlawful stopping and letting is supposed to be made and further says that when they stopped them at the gate there was not any manner of person or persons present with him his wife and son as is supposed neither was the said Robt Read when he passed with his timber through the gate or any of his men in danger of their lives as is supposed Robt Ives
