in the matter of variance for a long time obtaining in the court of requests between Edw Sibthorpe gentleman and Roger Harlakenden esq and Math Everard and Mary his wife and Xoph Sibthorpe defendants being amongst other things for and concerning the complainant's claim and interest of certain hop grounds in Earls Colne for a certain term of years together with the arrearage of the rents that are behind and due for the occupying of it by some of the defendants as by the complainant's bill at large is set forth and declared it is upon this present day upon the opening of the matter in court in the presence of the counsel learned of the complainant and the defendants by the counsel of the court ordered that a commission under privy seal shall forthwith out of this court be directed to Jas Morris esq attorney of the high court of wards and liveries giving him authority thereby to call the parties before him by all the ways and means that he may to try and search out the truth of the matters in the bill and thereupon finally to hear order and determine the same if he can by or before the feast of st james next if he cannot so do by the obstinacy of any of the said parties or otherwise then to certify to the counsel of this court in which of the parties fault shall be found that he could so end the same together with his opinion thereof and of his whole proceedings therein and it is further ordered that Math Everard shall forthwith together with one sufficient surety become bound to the complainant in the sum of 300li to stand to abide fulfil and perform any order rule or judgement Jas Morris shall award order rule determine or judge in this commission so the same be by him delivered by writing under his hand and seal to the parties or any of them by or before the feast of st james next concordat en regio
