this indenture made 6.5.1Jas2 1685 between Jn Fletcher the younger of Earls Colne yeoman and Rosamund his wife who was only daughter and heir of Toby Harris of Earls Colne deceased Francis Newton of Earls Colne yeoman and Susan his wife daughter of Susan Davy late of Earls Colne widow deceased who was sister and heir to Thos Morris late of Much Birch deceased Wm Clarke of Wakes Colne blacksmith and Eliz his wife on the one part and Jn Pattrick of Colchester blacksmith and Robt Barker of Earls Colne gentleman of the other part witnesseth that for the further and better setting assuring and sure making the messuages cottages lands and premises with appurtenances herein afore particularly mentioned and expressed to the several uses intents and purposes therein after particularly mentioned and expressed it is covenanted and concluded condescended and agreed by and between all and every the parties to these presents that they the said Jn Fletcher and Rosamund his wife Francis Newton and Susan his wife Wm Clarke and Eliz his wife shall and will at or before the end of the present easter term in due form of law acknowledge levy suffer and execute before his majesties justice of the court of common pleas at Westminster unto the said Robt Barker and his heirs one or more fine or fines sur cognisance de droit come ceo etc with proclamations to be thereupon had according to the usual course of fines of all that messuage or tenement and one rentary and yard with appurtenances called Seggis tenement and one certain separated way to the said messuage belonging which said messuage and premises herein before mentioned are situate lying and being in Earls Colne aforesaid and now are in the tenure and occupation of the said Jn Fletcher his assignee or assignees undertenant or undertenants and of and in one messuage and tenement together with all lands and pastures and woods thereupon being containing by estimation 4a be the same more or less with all and singular the appurtenances situate and being in Much Birch in the said county in the tenure and occupation of Thos Rayner and of and in two cottages and a garden thereunto belonging (hole in page) lying parcel of a tenement called Pippins contains in all 12r of ground and are situate and lying (torn) in the occupation of Thos Webb and Simon Dennish together with all ways (torn) anywise appertaining with their and every of their appurtenances by such name or names number contents quantities and qualities of acres and other description and in such manner and form as shall be thought fit and it is concluded condescended to and agreed by and between all parties to these presents of the premises or any part thereof shall and inure and shall be adjudged and taken to be and inure and the said counsee and his heirs shall stand and be seised of the said messuages cottages and lands and all singular the premises to the several uses intents and purposes herein after mentioned and declared and to and for no other use intent or purpose whatsoever that is to say as to for touching and concerning all that messuage or tenement and rentary and yard with appurtenances called Seggis tenement and one separated way to the said messuage or tenement belonging with appurtenances in the occupation of the said Jn Fletcher situate lying and being in Earls Colne to the only use and behoof of the said Jn Fletcher for and during the ter m of his natural life and from and after his decease to the said Rosamund Fletcher for and during the term of her natural life and from and after her decease to the use of the heirs of the body of the said Rosamund lawfully begotten or to be begotten by the said Jn Fletcher and for default of such issue to the use of the right heirs of the said Jn Fletcher forever and as to for touching and concerning the said messuage and tenement together with all lands pastures wood thereunto belonging containing by estimation 4a with all and singular appurtenances situate lying and being in Much Birch aforesaid in the tenure or occupation of the said Thos Rayner to the only use and behoof of the said Francis Newton during the term o f his natural life and from and after his decease to the said Susan Newton for and during the term of her natural life and from and after her decease to the use of the heirs of the said Susan lawfully begotten and to be begotten by the said Francis Newton and for default of such issue to the use of the right heirs of the said Francis Newton forever and as for touching and concerning the said two cottages and garden thereunto belonging whereupon the said cottages stand being parcel or reputed parcel of a tenement called Pippins and contain 12r of ground and are situate lying and being in White Colne aforesaid in the tenure and occupation of Thos Webb and Simon Denish and whereof no use is already limited to the only use and behoof of the said Jn Pattricke his heirs and assigns for ever in witness
