this indenture made 10.9.5WmM1 1693 between Thos Deeks of Halstead sayweaver on the one part and Simon Baylie of Earls Colne yeoman and Mary his wife on the other part witnesseth that the said Thos Deeks for and in consideration of the full and just sum of 10li to him in hand paid before the ensealing and delivery of these presents by the said Simon Baylie whereof he the said Thos Deeks doth acknowledge himself fully satisfied and paid hath granted aliened bargained sold and confirmed and by these presents doth fully and clearly bargain sell and confirm unto the said Simon Baylie and Mary his wife all that his freehold tenement or cottage situate standing and being in Earls Colne aforesaid in or on a green called Colne Green and now in the tenure or occupation of Margt Sexton widow or her assigns with all and singular the yards gardens backsides to the said tenement belonging or appertaining or with the said house or tenement commonly used occupied or enjoyed or which are accepted reputed or taken to be part parcel or member of the same and the reversion and reversions remainder etc of all and singular the said premises together with all and singular the deeds and writings touching or concerning the same or any part thereof and also all the estate right title interest etc of or to the same to have and to hold the said house or tenement and other the premises with appurtenances before by these presents bargained and sold or mentioned to be bargained or sold and every part and parcel thereof unto the said Simon Baylie and Mary his wife during the natural life of the said Simon and to the heirs and assigns of the said Mary Baylie wife of the said Simon to the only proper use and behoof of the said Mary Baylie and the heirs and assigns of the said Mary forever and the said Thos Deeks for himself his heirs executors and assigns doth covenant promise and agree that he the said Thos Deeks for and not withstanding any act done by him the said Thos Deeks to the contrary hath at the time of the ensealing and delivery of these presents is and standeth lawfully and rightfully seised in his demesne as of fee simple in his own right and to his own right and use without any condition limitation or other use or trust to alter change or determine the same estate of or in the said tenement or cottage and premises before mentioned to be hereby granted bargained and sold and of and in every part and parcel thereof and that the said Thos Deeks for and not withstanding any act done by him to the contrary now hath and at the time of the first estate to be had and executed to the said Simon Baylie and Mary his wife according to the true intent and meaning of these presents shall have full power just right and lawful authority to grant bargain and sell the same and every part and parcel thereof with the appurtenances unto the said Simon Baylie and Mary his wife and the heirs and assigns of the said Mary as is before in these presents mentioned and also that the same tenement and every part thereof with the appurtenances shall from henceforth forever remain and continue unto the said Simon Baylie and Mary his wife and to the heirs and assigns of the said Mary freely acquitted and discharged of and from all and all manner of bargain sales gifts grants dowers titles troubles and incumbrances whatsoever had made committed or wittingly or willingly suffered or done by the said Thos Deeks or by any other person or persons whatsoever lawfully claiming from by or under him the said Thos Deeks or by his means assent privity or procurement the rents and services from henceforth to grow due to the chief lord or lords of the fee or fees of the premises only excepted and foreprized and further that he the said Thos Deeks his heirs and assigns shall and will at all time and times hereafter within the space of 5years next ensuing the date of these presents upon the reasonable request and the cost and charges in the law of him the said Simon Baylie and Mary his wife and the heirs or assigns of either of them make suffer do acknowledge and execute or cause to be made etc all and every such further lawful and reasonable act etc for the further more perfect and better assuring and sure making of the premises aforementioned to be hereby bargained and sold and of every part and parcel thereof unto the said Simon Baylie and Mary his wife and to the heirs and assigns of the said Mary forever be it by fine or fines etc so as the said Thos Deeks his heirs or assigns etc who shall be required to make such further assurance be not compelled or compellable to travel further than the cities of London and Westminster or either of them in or about the making thereof and lastly it is covenanted granted concluded and condescended unto and fully agreed upon by and between the said parties to these presents to them their heirs and assigns by these presents that all fines feoffments recoveries and assurances in the law whatsoever had made levied knowledged suffered or done or hereafter to be had etc by or between the said parties to these presents or any of them of for touching or concerning the said tenement or cottage with appurtenances and all and other the before hereby granted premises with their rights members and appurtenances and every or any part thereof shall be and enure and shall be construed esteemed adjudged and taken to be and enure to the only proper use and behoof of him the said Simon Baylie and Mary his wife during their natural lives and after their death to the only proper use and behoof of the heirs of the said Mary forever and to none other use intent and purpose whatsoever in witness whereof to this indenture the said Thos Deeks have interchangeably set hand and seal the day and year first above written mark Thos Deeks
