mr Sparrow and mr Potter articles of agreement of the purchase of the lands in memo that we Edw Potter and Geo Potter the two sons of Edw Potter late of Colne Engaine yeoman deceased sold unto Jn Sparrow the younger of Earls Colne saymaker a freehold messuage or tenement and several outhouses with the yards lands and pasture grounds to the same belonging to the same and situate lying and being in Earls Colne aforesaid and now in the possession of the said Jn Sparrow for the sum of 190li and whereas the said estate is chargeable with several legacies given unto Wm Read and Mary Read in and by the last will and testament of Edw Potter the grandfather and Geo Potter the uncle of the said Edw Potter and Geo Potter and where by agreement there is to be paid to the said Wm Read and the administrator of the said Mary she being dead the sum of 87li12s6d which said money is to be left in the hands of the said Jn Sparrow to pay off the said Wm Read and the administrators of the said Mary their lawful demands so that the estate that the said Jn Sparrow hath bought and purchased of the said Edw Potter and Geo Potter may be freed and discharged from the said legacies etc by the said deed bearing date herewith and therefore agreed by and between the said Edw Potter and Geo Potter that they shall and will on or before thursday night next agree with and satisfy the said Reads their said legacies and interest so due upon his agreement the said Jn Sparrow is to pay such sum as is left in his hands for that purpose and in case the said Edw Potter and Geo Potter shall neglect and not make such agreement and procure good discharges from the said Wm Read and the administrators of the said Mary that then it shall be lawful for the said Jn Sparrow out of such money as is now within his hands to satisfy the said Wm Read and the administrators of the said Mary such their legacies as remains due and take sufficient discharges for the same to free and discharge the lands by him purchased and if any money shall be and remain out of the said 87li12s that then the said Jn Sparrow shall pay such overplus money if any to the said Edw and Geo Potter and if the same money shall fall short and not satisfy the same then the said Edw and Geo Potter shall pay to the said Jn Sparrow as he shall disburse over and above the said 87li12s6d in witness whereof we the said Edw Potter and Geo Potter have hereunto put our hands and seals 23.4.1705 Edw Potter Geo Potter Geo Toller Gilb Smith Jn Fletcher
