I Frances Biddulph of Earls Colne in the county of Essex widow being in health but mindful of my mortality do make this my last will and testament concerning the real and personal estate I have dower to dispose of as followeth first I give and devise my house outhouses buildings garths gardens and appurtenances both freehold and copyhold situate in Earls Colne aforesaid and now in my own occupation unto my niece Ann Holgate of Earls Colne aforesaid widow for term of her natural life and from and after her decease I give devise the said house outhouses and premises with the appurtenances to my niece Eliz Wale for her of her natural life and from and after her decease I give and devise the said house outhouses and premises with the appurtenances unto my nephew Rich Wale for term of his natural life and from and immediately after the decease of the survivor of them the said Ann Eliz and Rich if my niece Frances Humphreys the wife of Chas Humphreys of Halsted in the said county of Essex shall be then living then I give and devise the said house outhouses and premises with the appurtenances unto her the said Frances Humphreys and her heirs and if she shall not be then living my will is and I do in that case give and devise the said house outhouses and premises with the appurtenances unto my own right heirs and I do hereby declare my will and meaning is that it shall and may be lawful to and for every person and persons as they shall come to be in possession of the said house outhouses and premises with the appurtenances by virtue of my will by any writing or writings under their hand and seal testified in the presence of two or more credible witnesses to make any lease of the said house outhouses and premises to any person for any term or number of years not exceeding seven years so as such lease be made to commence in possession and not in reversion or at a date to come and be not made dispunishable of waste and so as upon all or every such lease there be reserved payable yearly during the continuance of such lease the best and most improved rent without the time of the making of thereof can or may be gotten for the same I also give and bequeath such part of my household goods brewing vessels pictures plate and furnitu re at my said house as my executor herein after named shall after my decease appoint to such person or persons as shall be in possession of the said house and premises b y virtue of this my will and to go as heirlooms item I give and bequeath unto the reverend mr Thos Barnard vicar of Earls Colne 20li all the rest and residue of my personal estate whatsoever and wheresoever after payment of all my debts funeral and other incidental charges and legacies herein by me given I give and bequeath unto my nephews Jn Wale Jeff Wale Chas Wale Rich Wale and unto my nieces Ann Holgate widow Eliz Wale Eliz the wife of mr Jas Robinson and Frances the wife of mr Chas Humphreys of Halsted share and share alike and I do hereby desire to be buried in linen privately in the chancel of Earls Colne in the same grave with the remains of my late dear husband and I do appoint my said nephew Jn Wale sole executor to this my will in witness whereof I the said Frances Biddulph have to this my will set my hand and seal the 3.12.1746 and published and declared the same to be my last will and testament Frances Biddulph signed and declared Frances Biddulph as her last will and testament in the presence of us who in her presence and at her request subscribed our names as witnesses thereunto Martha Boys Mary White and Sam Parkinson
