indenture made 29.3.1692 between Jn Hingham of Halstead in the county of Essex clothier Jn Garret (may be Jn Garret) of Great Coggeshall in the county aforesaid tailor and Thos Wright late of Earls Colne now of Stisted in the county aforesaid yeomen of the one part and Thos Brown Hedingham Sible in the county aforesaid clothier Jn King junior of Hedingham Sible aforesaid grocer Jn Cooke junior of Halstead aforesaid yeoman Geo Barnard of Halstead aforesaid yeoman and Jn Flood of Halstead aforesaid cordwainer of the second part and Francis Waldegrave of Clare in the county of Suffolk gentleman Jn King of Hedingham Sible aforesaid clothier Wm Swann of Halstead aforesaid clothier Joseph Baily of Tilbury in the said county of Essex yeoman Wm Chapman of Earls Colne aforesaid grocer Joseph Thrift of Earls Colne aforesaid clothier Robt Ludgater of Little Coggeshall in the county of Essex fellmonger Jn Isaac of Halstead aforesaid tanner and Wm Swann the younger of Halstead aforesaid clothier of the third part whereas in and by one indenture dated 20.12.1678 expressed to be made between Jn Garret of Earls Colne aforesaid maltster of the one part and Robt Harrington of Halstead aforesaid yeoman the aforesaid Jn Hingham Wm Barron of Halstead aforesaid sayweaver the said Jn Garret (may be Jn Garret) tailor and Thos Wright of the other part and in and by other good conveyances and assurances in the law the piece or parcel of ground and the house or building thereupon erected therein after mentioned are conveyed or mentioned to be conveyed unto the said Robt Harrington Jn Hingham Wm Barron Jn Garret (may be Jn Garret) tailor and Thos Wright their heirs and assigns to the use and behoof of the said Jn Garret maltster his assigns forever in trust nevertheless for the only use and benefit of the said Francis Waldegrave Jn King Jn Bunting of Halstead aforesaid clothier the said Wm Swann and Thos London of White Colne in the said county of Essex cooper their heirs and assigns forever and for that purpose to be from time to time conveyed according as they the said Francis Waldegrave Jn King Jn Bunting Wm Swann and Thos London and the survivor of them and the major part of such survivors and their heirs and assigns should from time to time direct and appoint it being the true intent of the said recited indenture and of all the parties thereunto that the premises thereby conveyed and every part and parcel of the same and the rents issues and profits thereof should from time to time and at all times forever then after be used employed and disposed to and for such purposes as they the said Francis Waldegrave Jn King Jn Bunting Wm Swann and Thos London their heirs and assigns and the major part of them for the time being should think fit and agree to use employ and dispose of the same and not otherwise as by the said recited indenture conveyance and assurance in the law relation unto them being had doth and may more fully and at large appear and whereas since the making of the said recited indenture the said Robt Harrington Wm Barron Jn Bunting and Thos London are deceased now this indenture witnesseth that the said Jn Hingham Jn Garret (may be Jn Garret) tailor and Thos Wright in discharge of the trust in and by the said recited indenture in them reposed and for divers other good causes and valuable considerations them hereunto respectively and specially moving have and every of them hath granted aliened released ratified and quitclaimed and confirmed and by these presents do and every of them doth at the special instance and request nomination and appointment of the said Francis Waldegrave Jn King and Wm Swann testified by their being made parties to these presents and sealing and delivery thereof grant alien release ratify quitclaim and confirm unto the said Thos Brown Jn King junior Jn Cooke junior Geo Barnard Jn Flood in their actual possess ion now being by virtue of one indenture of bargain and sale for one year bearing date the day before the date of these presents to them made and of the statute for transferring of uses into possession and their heirs all that piece or parcel of ground part of a close of land late of the aforenamed Jn Garret maltster lying and being in Earls Colne aforesaid containing by estimation 32p more or less as the said piece or parcel of land is enclosed with a pale fence abutting upon a lane or passage leading from the street in Earls Colne aforesaid to certain lands called Burrowes Lands towards the west and upon a freehold messuage now or late of Theodosia Harris with commonly called or known by the name of The Lyon towards the south with a house o r building upon the said granted premises or some part thereof erected formerly in the tenure or occupation of the said Jn Garret maltster and now or late in the tenure or occupation of the said Wm Swann or his assigns and the reversion and reversion remainder and remainders rents services and profits and all and singular the premises with their and every of their appurtenances and all the estate right title interest claim and demand whatsoever that Jn Hingham Jn Garret (may be Jn Garret) tailor and Thos Wright now have may might should or any wise ought to have of and in the said piece or parcel of ground tenement house or building or any part or parcel thereof and all deeds and evidences writings and muniments whatsoever touching and concerning the premises only or any part thereof to have and to hold the said piece or parcel of ground with the tenement building or house there upon built and all and singular other the premises with their and every of their rights members and appurtenances unto the said Thos Brown Jn King junior Jn Cooke junior Geo Barnard and Jn Flood their heirs and assigns forever to the use and behoof of the said Thos Brown Jn King junior Jn Cooke junior Geo Barnard and Jn Flood their heirs and assigns forever in trust nevertheless for the only use and benefit of the said Francis Waldegrave and Jn King Wm Swann Joseph Baily Wm Chapman Joseph Thrift Robt Ludgater Jn Isaac and Wm Swann junior their heirs and assigns forever and for that purpose to be from time to time conveyed according as they the said Francis Waldegrave Jn King Wm Swann Joseph Bayly Wm Chapman Joseph Thrift Robt Ludgater Jn Isaac and Wm Swann junior and the survivor and survivors of them and the heirs or assigns of the survivor or survivors of them shall from time to time direct and appoint it being the true intent of these presents and of all the parties thereunto that the said premises and every part or parcel of the same and the rents issues and profits thereof shall from time to time and at all times forever hereafter be used employed and disposed to and for such purposes as they the said Francis Waldegrave Jn King Wm Swann Joseph Baily Wm Chapman Joseph Thrift Robt Ludgater Jn Isaac and Wm Swann junior and the survivor or survivors of them and the heirs and assigns of the survivor or survivors of them for the time being shall think fit and agree to use employ and dispose of the same and not otherwise and the said Jn Hingham Jn Garret (may be Jn Garret) tailor and Thos Wright do for themselves their heirs executors and administrators covenant grant and agree to and with the said Thos Brown Jn King junior Jn Cooke junior Geo Barnard and Jn Flood and their heirs by these presents that they the said Jn Hingham Jn Garret (may be Jn Garret) tailor and Thos Wright have not at any time heretofore done any act or acts thing or things whatsoever whereby or by means whereof the hereby granted premises or any part thereof are is shall or may be impeached or encumbered in by or with any manner of estate title charge or
