in the name of god amen the 1.3.1569 I Jn Warde the elder of Earls Colne in the county of Essex and in the diocese of London being sick in body but of whole of mind and of good remembrance make and ordain this my testament containing herein my last will in manner and form following first I bequeath my soul to almighty god the father to jesus christ his son and to the holy ghost and to all the company of heaven and my body to buried in the churchyard of Earls Colne aforesaid on the south side of the chancel there item I bequeath to the poor men's box of the same town 2s item I bequeath to Rose my wife all my stuff and implements of household six beasts to take her those among all my beasts which her beasts I will shall be pastured in my ground called Bandley unto such time as my executor have taken away his crop this year upon the lands called the Gall and then to pasture there and in the foresaid Bandley and Gall to pasture during her natural life item I bequeath to my said wife 12bush of wheat 12bush maslin two seams barley a load of wheat straw and a load of barley straw and oat straw together all which corn and straw I will shall be delivered to her yearly at her dwelling house in Colne aforesaid by my executor during all the term of years yet to come in my farm called Sherryffes if she shall chance to live so long and 1a2r of meadow in the common meadow in Gaines Colne she to mow and make it at her cost and charge and also to have both the first crop and the latter crop and my executor to carry it to her dwelling house in Colne aforesaid at his proper cost and charge item I give and bequeath to my son Jas Warde two bullocks of two years old and two sheep item I bequeath to my daughter Xian Warde two bullocks one of a year old the other of two years old and all my part of the lambs and wool which I ought to have for the keeping of eight sheep of Robt Ball's of White Colne until lammas item I bequeath to Margt Prentice my daughter's daughter a brown bullock with a white face of a years age item I bequeath to my son Jn Warde all that my lease of Sheryves with the appurtenances to have and to occupy the same during all the term of years yet to come therein all the corn on the ground there and also on the land called the Gall all the rest of my cattle as horses mares gelding colt sheep lambs beast bullock cart plough with the appurtenances all instruments there belonging to husbandry paying to Robt Warde my son 5li of good and lawful money of England within five years next and immediately ensuing after my decease in manner following that is to say yearly 20s at one whole and entire payment during the said five years without coven fraud or for their delay item I will and give to Rose my said wife my tenement that I now dwell in and the croft on the back side with the appurtenances my land called Gall with the appurtenances to have to hold and her assigns during all the term of her life and after her decease I will my said tenement with the croft on the back side and my said ground called the Gall with the appurtenances shall remain wholly to Jn Warde my son and to his heirs and assigns forever paying to my daughter Xian Warde 6li13s4d of good and lawful money of England within four years next immediately ensuing his entering into the same in manner following that is to say the yearly 23s4d at one whole and entire payment during the said four years without coven fraud as for the delay and my tenement called Powels and the croft thereto belonging with the appurtenances I will shall remain immediately after my decease to my son Jas Warde and his heirs forever item I will and give to my son Jn Warde all that my right and title that I ought to have for my part in all those parcel of free land I late purchased of Edw Webbe of Colchester which land the said Edw lately purchased of one Nich Veer that is to say their whole half of a certain piece of land called Great Bandley and Lityll Bandley with their whole half of a goovett belonging to the same lying in White Colne their whole half of a piece of land called Goldhurds lying in Colne Yngayne their whole half of a parcel of land called Chawpitell lying in White Colne their whole parcel of land called Pettcroft lying in Colne Engaine to have him and to his heirs forever reserving the parcel and feeding of the said Bandley to Rose my said wife as is before expressed during her natural life item I give unto Jas Warde my son my whole part of all such parcels of copyhold land as I late purchased of the aforesaid Edw Webb called Brownfield and Cost Croft lying in White Colne to have to him and to his heirs and assigns forever my said wife having parcel and feeding thereof during her life natural item I make and ordain my said son Jn Warde to be my executor to pay my legacies and all my debts and to take up my debts to bring my body honestly to the earth under this condition that he shall in all his doing concerning my will do nothing but by that wise and counsel of Robt Ball and Thos Bridge my well beloved friends whom I make my supervisors of this my testament and last will and I give to either of them for their pains taken about the same 6s8d and also the cost and charge as oft as they shall go about anything concerning the same and if these two my friends shall think by their discretion that my said son is not meet to take so great charge upon him or that he will not be ordered by them in his doing as my will is he shall be then I will that they jointly have the part before given to him wholly into their hands and they to pay my legacies and debts and then to deliver all the rest into his hands again their cost to them reasonably allowed and to give him account of all their doing and he to give them a
