in the name of god amen I Jn Sarjant of Chappell alias Pontesbright in the county of Essex clerk being in good health and of a sound and perfect mind and memory thanks be to god do make and ordain this my last will and testament in manner following hereby revoking all former wills by me made first and principally I commend my soul into the hands of almighty god my most merciful creator trusting to be saved through the alone merits of jesus christ my most gracious redeemer and my body I desire may be buried at the discretion of my executrix herein after named and as to that worldly estate wherewith it hath pleased god to bless me I dispose thereof as followeth imprimis I give and bequeath unto my eldest son Jn Sarjant who is gone beyond the seas and to his heirs forever if he be living and shall come over from beyond the seas within five years next after my decease all those my copyhold lands meadows and pastures with the appurtenances which I lately purchased of Jn Rawlinson situate lying and being in White Colne in the county of Essex and now in the occupation of Thos Wright and holden of the manor of Barwicke Hall in White Colne aforesaid but in case my said son Jn be not living or do not come over from beyond the seas within five years next after my decease then I give and bequeath the said lands meadows and pastures with the appurtenances unto my daughter Mary Sarjant and her heirs forever and my will and mind is that my said daughter Mary and her heirs shall receive the rents and profits of the said lands and premises to her and their own use and uses until my said son Jn shall come over as aforesaid without giving him any account for the same item I give and bequeath unto my daughter Susanna Sarjant and her heirs forever all those my copyhold lands and tenements holden of the manor of Colne Priory and late in the occupation of Wm Fossett or his assigns and which I sometime had and purchased of Jn Morley and his wife upon condition that my said daughter Susanna her heirs or assigns shall and do well and truly pay or cause to be paid unto my daughter Joanna the wife of Joshua Sparrow the sum of 40li of lawful money of England that is to say 20li within one year next after my decease and 20li within two years next after my decease and in case my said daughter Susanna or her heirs shall refuse or neglect to pay the said 40li unto my said daughter Joanna Sparrow or any part thereof contrary to the true intent and meaning of this my will then my mind and will is that my said daughter Joanna or her assigns shall enter into and upon the said lands and premises herein before given unto my said daughter Susanna and the same shall hold and enjoy until the said 40li with the interest thereof from the time the same ought to have been shall be fully satisfied and paid together with such charges as she shall be put unto for the recovery thereof but my mind and will further is that in case my said son Jn Sarjant shall come over from beyond the seas within five years next after my decease as aforesaid then that my said daughter Susanna her heirs or assigns shall out of the lands and premises herein before given unto her well and truly pay or cause to be paid unto my said daughter Mary the sum of 20li of lawful money of England within six months next after such time as my said son Jn shall come over as aforesaid and in case my said daughter Susanna or her heirs shall refuse or neglect to pay the said 20li or any part thereof unto my said daughter Mary then I will that my said daughter Mary or her assigns shall and may enter into and upon the said lands and premises herein before given unto my said daughter Susanna and the same shall hold and enjoy until the said 20li with the interest thereof from the time the same ought to have been paid shall be fully satisfied and paid together with all such charges as she shall be put unto for the recovery thereof and also my mind and will further is that in case my said son Jn shall come over as aforesaid that then my said daughter Joanna her executors administrators or assigns shall well and truly pay or cause to be paid unto my said daughter Mary the sum of 20li part of the said 40li herein before given unto my said daughter Joanna as aforesaid within six months next after such time as my said son Jn shall come over as aforesaid item I give and bequeath unto my son Sam Sarjant and his heirs forever all those my copyhold lands meadows and pastures with the appurtenances which I lately purchased of Rich Appleton and his wife holden of the several manors of Earls Colne and Barwickehall and now in the occupation of Geo Toller gent or his assigns also I give unto my said son Sam Sarjant the sum of 10li of lawful money of England to be paid him by my executrix within six months next after my decease in case my said son Sam shall be a good husband and my executrix shall think fit to pay him the same item whereas I have in the hands of Solomon Grimston of Chappell aforesaid the sum of 50li I will and desire that the same may remain in his hands and that the interest thereof at the rate of 5li percent per annum be paid unto my said son Sam for and during the term of his natural life half yearly by equal payments the first payment to be made six months next after my decease item I give and bequeath unto my son Math Sarjant and his heirs forever all that my cottage or tenement with the outhouse and appurtenances thereunto belonging which I lately purchased of Edw Quilter and also all those my copyhold lands and premises holden of the manor of Bures ad Montem which I purchased of Rich Syday item I give and bequeath unto my said daughter Mary Sarjant the sum of 20li of lawful money of England to be paid her by my executrix within six months next after my decease item all the rest and residue of my goods chattels ready money debts bills bonds mortgages and personal estate whatsoever after my debts legacies and funeral charges shall be satisfied and paid I give and bequeath unto my loving wife Mary Sarjant and lastly I do nominate and appoint my said loving wife Mary Sarjant my sole executrix of this my last will and testament in witness whereof to this my last will and testament I have set my hand and seal the 15.3.1698 signed sealed published and declared by the testator in our presence and then this last will was attested
