this is the last will and testament of Isaac Rice of Earls Colne in the county of Essex yeoman first I give and devise to Ambrose Marven the elder of Earls Colne bricklayer and his heirs all that my messuage cottage or tenement wherein I now dwell with all and every the appurtenances thereunto belonging or in anywise thereunto appertaining situate lying and being in Earls Colne aforesaid upon trust and confidence and to the intent and purpose that he my said trustee his executors and administrators or one of them do as soon as conveniently may be after my decease sell convey and dispose of the same for the best price or prices that can be gotten therefore and the money or monies arising from such sale or sales after deducting the necessary expenses attending the same I give and dispose of as hereinafter mentioned and it is my will that the receipt or receipts of my said trustee his executors or administrators shall be a good and sufficient discharge or discharges in law to the purchaser or purchasers of my said messuage and premises for the purchase thereof and that the purchaser or purchasers of the same shall not be answerable for the misapplication or nonapplication of the purchase money arising from the sale thereof and my will further is that the money arising from the sale of my said messuage cottage or tenement shall be received and taken as part of my personal estate together with my other personal property after payment of all my debts funeral expenses and probate of this my will I give and bequeath as follows (that is to say) I give and bequeath to my brother in law Jn Howard the sum of £20 and also my best feather bed also I give and bequeath to the two daughters of my said brother in law Jn Howard the sum of £5 apiece also I give and bequeath to my brother in law Wm Death of St Osyth in the said county husbandman the sum of £10 also I give and bequeath to my nephew Jn Underwood of Brightlingsea (son of Jn Underwood late of Aldham in the said county oyster dredger the sum of £10 also I give and bequeath to Robt Davey son of Jn Davey of Bricklingsea (sic) aforesaid the sum of £10 also I give and bequeath to Mary Davey daughter of Margt Davey deceased the sum of £10 also I give and bequeath to Eliz Bryant widow of Jn Bryant late of Bricklingsea aforesaid oyster dredger the sum of £10 also I give and bequeath to my cousin Jn Hurrell of Little Cornard in the county of Suffolk husbandman the sum of £20 and all my wearing apparel also I give and bequeath unto my cousin Hannah Hurrell of Earls Colne aforesaid my housekeeper the sum of £20 and all my household furniture (except what is herein before given and disposed of) and my will is that if my two brothers in law or either of them should happen to die during my life time that then the legacy or legacies herein before by me given to my said two brothers in law Jn Howard and Wm Death shall be equally divided amongst the children such brother in law so dying shall leave share and share alike if more than one and if only one then I give the same to such only child and my will further is that if it should so happen that my estate and monies at the time of my decease should not be sufficient to pay the several legacies by me herein given then it is my will that the said several legatees shall be paid in proportion as far as the same amount to or in case any surplus should remain after payment of the said several legacies that the same should be equally divided amongst all the said several legatees share and share alike and I do hereby nominate constitute and appoint the aforesaid Ambrose Marven the elder of Earls Colne aforesaid bricklayer sole executor of this my last will and testament in witness whereof I have hereunto set my hand and seal 6.5.1802 Isaac Rice signed sealed published and declared by the said Isaac Rice the testator as and for his last will and testament in our presence and at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto Rich Younge Ann Algar Hen Algar
