this is the last will and testament of me Robt King of Earls Colne in the county of Essex draper made and published by me whilst I am in good health and of a sound mind memory and understanding in manner and form following that is to say first I give and devise to my brother Jn King of Sudbury in the county of Suffolk draper and my friend Jn Pitstow of Earls Colne aforesaid miller (my executors hereinafter named) and to their heirs and assigns all and every my freehold messuages lands tenements and hereditaments situate lying and being in Earls Colne aforesaid or in any other parish or place in the county of Essex with their and every of their several and respective rights members and appurtenances upon trust as soon as conveniently may be after my decease to sell and dispose thereof either together or in parcels as they my executors and trustees shall think fit and either by public or private sale as may be thought most advantageous and the money arising by and from the sale or sales thereof I do hereby will and direct shall be INSERTED to and considered and taken as part of my personal estate for the purposes hereinafter expressed and declared also I do hereby order and direst that the said Jn King and Jn Pitstow my executors herein after named or the survivor of them or the executors or administrators of the survivor as soon as conveniently may be after my decease to sell and dispose of all and every my customary or copyhold messuages lands tenements and hereditaments situate lying and being in Earls Colne aforesaid or in any other parish or place in the said county of Essex with their and every of their rights members and appurtenances and held of the manors of Earls Colne and Colne Priory or one of them and which I have duly surrendered to the use of my will or of any other manor or manors in the county of Essex wither together or in parcels as they my said executors shall think fit and the money arising by and from the sale or sales thereof I do hereby order and direct shall be INSERTED to and considered and taken and disposed of as part of my personal estate for the purpose hereinafter mentioned expressed and declared of and concerning the same and I do hereby declare my mind and will to be that the receipt or receipts of my executors or the survivor of them his heirs executors or administrators for the purchase money or monies for which my said several freehold and customary and copyhold messuages or tenements lands hereditaments and premises shall be sold pursuant to this my will shall be a good and effectual discharge and discharges both at law and in equity to the purchaser or purchasers thereof for and notwithstanding any misapplication or nonapplication of such purchase money or monies or any part thereof and that the purchaser or purchasers thereof shall not be obliged to see to the due application thereof or any part thereof also I give and bequeath unto Martha my beloved wife the sum of £100 of good and lawful money of Great Britain to be paid unto her out of my personal estate by my executors herein after named within twelve months next after my decease also I give and bequeath to the said Martha my wife all and every my household goods and household furniture plate linen and china to and for her own proper use and behoof also after payment of my just debts my funeral expenses the charges of the probate of this my will and all costs charges and expenses attending the due execution hereof and the aforesaid legacy I give and bequeath the rest residue and remainder of my goods chattels stock in trade ready money and securities for money and all other my personal estate and effects whatsoever and wheresoever and of what nature sort or kind soever the same are situate or being unto the said Jn King and Jn Pitstow my executors hereinafter named their executors and administrators upon trust to convert such part thereof as shall not be in money into money and after adding thereto the monies to arise by the sale or sales of said my free and copyhold messuages lands and hereditaments to place out and invest the same at interest in their names as soon as conveniently may be upon some real security or securities or in some or one of the public funds of this kingdom and the interest dividends or proceed thereof I do hereby will and direct shall be paid to the said Martha my wife for and during the term of her natural life as the same shall become due and be received and from and immediately after the decease of the said Martha my wife I give and bequeath the sum of £100 apiece to all such of my children by the said Martha my wife that shall be living at the time of her decease to be paid unto them by my said executors and trustees from and out of the said trust monies and all the rest and residue of the said trust monies I give and bequeath unto all my children by Mary my late wife and by Martha my now wife that shall be living at the time of the decease of the said Martha equally to be divided between them part and share alike and to be paid unto them respectively by my said trustees and executors also I do hereby declare my mind and will to be that the several legacies and bequests by me herein made and given to the said Martha my wife shall be in lieu and bar and in full satisfaction of and for all dower and thirds and right and title of dower and thirds and free bench which she shall or may have or claim to be entitled to or can or may have or claim out of all or any part of my said free and copyhold messuages lands and hereditaments also I do hereby nominate constitute and appoint my said brother Jn King and the said Jn Pitstow jointly executors of this my will and also guardians of all and every my children during their respective minorities and I do hereby declare my mind and will to be that it shall and may be lawful to and for my said executors and trustees and each of them and their and each of their respective heirs executors and administrators to deduct and reimburse himself and themselves respectively from and out of the monies that shall come to their hands under and by virtue of this my will and all their and each of their reasonable costs charges and expenses in the execution of this my will and the trusts hereby in them reposed and that they my said trustees and executors or either of them their or either of their heirs executors or administrators shall not be answerable or accountable for any more or other sum or sums of money than they shall actually and respectively receive or which shall come to their respective hands by virtue of this my will and the several trusts hereby by me in them reposed and that they my said trustees and executors or either of them shall not be answerable or accountable for the acts deeds receipts defaults disbursements or payments of the other his heirs executors or administrators but each of them for his and their own particular acts deeds receipts defaults disbursements or payments only and lastly I do hereby revoke and make void all former and other wills by me at any time or times heretofore made and I do hereby publish and declare this only to be my last will and testament in witness whereof I the said Robt King the testator have to this my last will and testament set my hand and seal the 16.6.1800 Robt King signed sealed published and declared
