this is the last will and testament of me Sam Sadd of Earls Colne in the county of Essex baker made in manner following that is to say first I nominate constitute and appoint Rich Latimer Dell of Earls Colne aforesaid miller and Zachariah Coe of the same place wheelwright executors or this my will I direct all my just debts funeral and testamentary expenses to be paid and satisfied I devise all the freehold messuages or tenements lands and hereditaments to which I shall be entitled at my decease with their appurtenances and all other my real estate whatsoever (except my copyhold or customary messuages lands tenements and hereditaments and bequeath all the personal estate which shall belong to me at my decease unto and to the use of the said Rich Latimer Dell and Zachariah Coe their heirs executors administrators and assigns according to the nature thereof respectively upon trust to sell my real estate and get in my personal estate when and as the trustees or trustee for the time being of my will shall in their discretion deem it most advantageous so to do and in the mean time such real and personal estate and the rents interest and produce respectively shall be subject to the trusts and provisions hereinafter contained concerning the money to arise therefrom and concerning the income of such money and such real estate shall be considered as converted in equity from the time of my decease for the purposes of such trusts and provisions I hereby direct authorise and empower the said Rich Latimer Dell and Zachariah Coe or the survivor or them or the heirs executors administrators or assigns of such survivor to make sale and absolutely dispose of all and every my copyhold or customary messuages lands tenements and hereditaments whatsoever and wheresoever in such way and manner either by public auction or private contract and at such time or times as my said trustees or trustee shall deem it advantageous so to do and do and shall execute all necessary conveyances and other assurances to the purchaser or purchasers thereof and after payment of all my just debts funeral and testamentary expenses and the charges and expenses attending such sale or sales aforesaid upon further trust to stand possessed of the money to arise by the sale of my said freehold copyhold and personal estate for the purposes following that is to say upon trust to pay one half part of the clear sum aforesaid unto my dear wife Leticia Sadd to whom I give and bequeath the same for her sole use benefit and disposal and upon further trust to pay the remaining moiety thereof unto equally between and among all and every my children that shall be living at the time of my decease share and share alike and not to the issue of any one or more of my said children that may be then dead I declare that the receipts of my said trustees to purchasers and others for moneys paid to them shall be sufficient discharges for the same and from all liability to see to the application thereof further I declare that my trustees their heirs executors and administrators shall be answerable for their own respective receipts and defaults only and shall be at liberty to retain and allow to each other their respective reasonable disbursements and expenses hereby revoking all other testamentary writings in witness whereof I have hereunto set my hand this 14.9.1842 Sam Sadd signed by the said testator as his last will and testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have subscribed our names as witnesses Sam Tillett conveyancer Colchester Jn Watts his clerk
