whereas at a court here held the monday after the feast of holy trinity 2.6.3Eliz1 Robt Jolly was admitted tenant of the lord for himself and his heirs to one enclosed field called Little Sandehill containing by estimation 13a of land lying between lands called Greate Sandhill on one part and the king's highway leading from Earls Colne towards Coggeshall on the other part as by a roll of the same court here shown in court it is shown now at this court it is shown by the homage that the aforesaid Robt Jolly died several years ago and before his death he surrendered the said land into the hands of the lord to the use and behoof of his last testament and last will by which he gave and bequeathed the aforesaid premises in these following english words item I do give and bequeath unto Agnes Jollyie my wife all that my house and lands called by the name of Sandehille and Hansers Hedge situate and lying within the said parish of Earls Colne Sandehills holden of the right honourable the earl of Oxenford of the manor of Colne Priory and the other called Hansers Hedge holden of the right worshipful mr Roger Harlakenden held of the earldom to have and to hold to my said wife and to her assigns during the term of her natural life without diminishing any whit from her and after the decease of my said wife I do will that it shall remain withal to my eldest son Jn Jollie and to his assigns during the term of his natural life conditional that he shall not suffer any strip or waste on the same grounds nor suffer to be done as concerning the felling of any trees that which shall be thought necessary and meet and after the decease of my said son Jn Jollie I do will my said house and lands shall wholly remain unto my other two sons Robt Jolly and Wm Jolly equally and to their heirs of their bodies lawfully begotten forever and if it shall hap my said two sons Robt and Wm to decease without heirs of their bodies lawfully begotten that then I do will that it shall remain equally amongst all my children as shall then be living and to their heirs forever as by the said will and testament under the seal and proved by the ordinary for this place here in court produced and clearly shown and also it was shown by the said homage that the aforesaid Agnes late wife of the said Robt Jolly died after the last court seised of such her estate upon which to this court came the said Jn Jolly in person and sought admittance for himself to the aforesaid lands called Little Sandhill according to the form and effect of the will and the aforesaid surrender to whom the lord by his aforesaid steward granted thereof seisin to have to the said Jn Jolly and his assigns for the natural lifetime of Jn himself upon the aforesaid conditions the remainder thereof as stated above to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord his fine as is shown in the margin     and made fealty and was admitted thereof tenant of the lord in the aforesaid form
