and furthermore at this court it is shown by the homage that Barth Church gentleman customary tenant of this manor after the last court and before this court viz 29.4.1629 surrendered into the hands of the lord by the hands of Simon Ive instead of the bailiff in the presence of Jn Hawksby clerk and Rich Kempe two customary tenants of the aforesaid manor the same testifying according to the custom of the aforesaid manor among other things all that customary messuage or tenement called Clarks and five crofts or parcels of customary land lying on the backside of the aforesaid messuage in Earls Colne held of the aforesaid manor namely all H his lands tenements and hereditaments customarily held of the aforesaid manor to the use and intention of his last will and testament and signed and proved under the seal of the ordinary of this place produced and shown here in court by which it is agreed by the court that the aforesaid Barth by his aforesaid testament willed and bequeathed all that messuage called Clarks and five crofts of land to the aforesaid Mary Church his sister and the heirs of the said Mary forever and afterwards and before this court the aforesaid Barth died thus seised thereof upon which came the aforesaid Mary Church here into court and humbly sought admittance to whom the lord by his aforesaid steward granted and delivered thereof seisin by the rod to have the aforesaid messuage called Clarks and other premises with appurtenances to the aforesaid Mary Church her heirs and assigns forever to hold from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and she gave to the lord her fine but fealty was respited because she was under age and thus she was admitted tenant thereof and afterwards in this same court and the court sitting came Rose Church widow mother of the aforesaid Barth and Mary and surrendered into the hands of the lord by the hands of the aforesaid steward and by licence of the lord for herself and her heirs relaxed remitted and quitclaimed to the aforesaid Mary Church her heirs and assigns all her right title claim and interest whatsoever of and in the aforesaid messuage called Clarks and the aforesaid five crofts or parcels of land with appurtenances and for such a licence the aforesaid Mary gave to the lord for a fine etc
