but because it was shown by the homage that the aforesaid surrender was not made according to the custom of the aforesaid manor because the aforesaid Edw Spooner was not a customary tenant of the aforesaid manor as he should be by the custom of the aforesaid manor therefore Sam Burton the son and heir of the said Sam Burton came into court and for certain considerations contained in certain articles of agreement made between the said Ann and Sam bearing the date of the day of this court surrendered into the hands of the lord by the hands of the aforesaid steward the aforesaid tenement with garden crofts lands and other premises with appurtenances to the use and behoof of the said Ann for her lifetime the remainder thereof according to the tenor of the said will of his father and by licence of the lord for himself and his heirs remitted released and forever quitclaimed all his right and demand whatsoever in and to the aforesaid tenement garden croft of land and other premises with appurtenances to the aforesaid Ann Wm and Rich and their heirs forever and for such a licence the aforesaid Ann gave to the lord for a fine etc
