but because it was shown by the homage that the aforesaid surrender was not made according to the custom of the aforesaid manor because the aforesaid Edw Spooner was not a customary tenant of the aforesaid manor as he should have been according to the custom of the aforesaid manor therefore Sam Burton son and heir of the said Sam Burton deceased came into court and for certain considerations contained in certain articles of agreement made between the said Sam and Ann bearing the date of the day of this court surrendered into the hands of the lord by the hands of the aforesaid steward the aforesaid croft of land with appurtenances to the use and behoof of the said Ann for her lifetime and after her decease to the use of the said Rich Burton and his heirs forever and by licence of the lord for himself and his heirs remitted and forever quitclaimed to the aforesaid Ann and Rich and the heirs of the said Rich all his right title and demand whatsoever in and to the aforesaid croft of land with appurtenances and for such a licence they gave to the lord for a fine etc
