whereas at a view with court here held 20.10.1625 Sam Burton senior was admitted tenant of the lord for himself and his heirs to one croft of land containing 3a more or less called Crossefield as by a roll of the aforesaid court it appears now at this court it is shown by the homage that after the last court and before this court viz 28.8.1637 the aforesaid Sam Burton surrendered into the hands of the lord by the hands of Robt Potter instead of the bailiff in the presence of Edw Elliston gentleman customary tenant of the aforesaid manor and Edw Spooner senior the same testifying the aforesaid croft of land with appurtenances to the use and intention of his last will and afterwards viz that same day 28.8.1637 the aforesaid Sam Burton wrote his last will and testament in writing and by the same will gave and bequeathed the aforesaid croft of land with appurtenances to Ann Burton his wife for her lifetime and after her decease the remainder thereof to Rich Burton second son of the said Sam and the heirs of the said Rich forever upon which came here into court the aforesaid Ann Burton and humbly sought admittance to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid croft of land with appurtenances to the aforesaid Ann and her assigns for her lifetime the remainder thereof in the aforesaid form from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and be right accustomed and she gave to the lord for a fine and made fealty etc
