but because it was shown by the homage that the aforesaid surrender was not made according to the custom of the aforesaid manor because the aforesaid Edw Spooner was not a customary tenant of the aforesaid manor as he should have been by custom of the aforesaid manor therefore Sam Burton the son and heir of the said Sam Burton came into court and for certain considerations contained in certain articles of agreement made in writing bearing the date of the day of this court between the said Sam and Ann he surrendered into the hands of the lord by the hands of the aforesaid steward the aforesaid tenement and garden with appurtenances to the use and behoof of the said Ann for her lifetime the remainder thereof to the use of Rich Burton and his heirs and by licence of the lord for himself and his heirs released and forever quitclaimed to the aforesaid Ann and Rich and the heirs of the said Rich all his right and demand whatsoever of and in the aforesaid tenement and garden with appurtenances and for such a licence they gave to the lord their fine etc
