and afterwards to this same court came the aforesaid Jn Kent Geo Bentall and Ann his wife daughter and heir of Ann Kent deceased Ann Bentall herself solely and secretly examined by the aforesaid steward as is the custom and they surrendered into the hands of the lord by the hands of his aforesaid steward in full and open court the aforesaid croft with garden enclosed and the aforesaid two crofts of land lying between Milles Fenne and the brook containing 5a more or less and the aforesaid two crofts of land whereof one croft of land lies between Sandhill containing by estimation 4a of land and the other croft of land is parcel of Milles Fenne and lies between the said croft of land and the king's highway leading towards Tey with appurtenances and all and every reversion or reversions remainder or remainders of the premises to the use and behoof of Edm Coxe and Ann Gray widow their heirs and assigns forever upon condition that if the aforesaid Jn Kent Geo Bentall and Ann his wife or any of them their heirs executors of assigns or any of them should pay or cause to be paid to the said Edm Coxe and Ann Gray or either of them their heirs executors or assigns or any of them the annual sum of 10li of legal money of England each year and for each year during the term of ten years from 26.12.next and to make full payment and to settle in and upon the feast day of the nativity of st jn bapt and the feast of xmas or within two days after the aforesaid feasts by equal portions in or at the dwelling house of the said Edm Coxe situated in Great Coggeshall and 150li of legal money of England in or upon the feast day of xmas 25.12.1648 or within two days after the said feast at or in the aforesaid dwelling house with the 5li which shall then be owed of the aforesaid annual sum of 10li and all rents dues and expenses which shall have accrued during the aforesaid term of ten years and should happen by occasion of the aforesaid surrender that then the surrender should be void and of no force provided always and it is agreed between the aforesaid parties that the aforesaid Jn Kent Geo Bentall and Ann his wife and any of them and the heirs and assigns of the said Ann should be allowed the aforesaid surrender not withstanding to receive and retain to themselves the proper use respecting the rents and profits of all and singular the premises unless default should be made in the annual payment of the aforesaid sum or any parcel thereof mentioned in the aforesaid conditions and not for longer upon which came here into court the aforesaid Edm Coxe and Ann Gray and humbly sought admittance to whom viz the aforesaid Edm Coxe in person and the aforesaid Ann Gray by Thos Coxe her deputy the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid croft of land and all and singular the premises with appurtenances to the aforesaid Edm Coxe and Ann Gray their heirs and assigns upon the condition and aforesaid agreement from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and they gave to the lord for their fines etc
