whereas at a court here held 31.5.1620 Thos King was admitted tenant of the lord for himself and his heirs to one parcel of land called Kings Garden and whereas at a court here held 28.12.1641 it was shown by the homage that the aforesaid Thos King after the last court and before this said court viz 28.1.1641 surrendered into the hands of the lord by the hands of Robt Guyon instead of the bailiff in the presence of Jn Munt and Ambrose Waller two customary tenants of the aforesaid manor the same testifying the aforesaid parcel of land with appurtenances to the use and behoof of Jn Middleton of Wakes Colne bricklayer and his heirs upon the condition that if the aforesaid Thos King his heirs of assigns should pay or cause to be paid to the aforesaid Jn Middleton or his assigns 10li16s of legal money of England on 20.1.1642 at the dwelling house of the said Jn Middleton in the aforesaid Wakes Colne that then the aforesaid surrender should be void as by a roll of the aforesaid court it appears now to this court came the aforesaid Jn Middleton and gave the court here information that the aforesaid 10li16s nor any parcel thereof has not been paid at the day and aforesaid place and remains unpaid now whereof he sought admittance to the premises to whom the lord by the aforesaid steward granted and delivered thereof seisin by the rod to have and to hold the aforesaid parcel of land with appurtenances to the aforesaid Jn Middleton his heirs and assigns from the lord by the rod at the will of the lord according to the custom of the aforesaid manor by the rents services and customs thereunto belonging and by right accustomed and his fine was pardoned by the lord's grace
