whereas at a court held for the said manor 13.10.1637 Thos Hales was admitted tenant to him and his heirs unto two crofts of lands called Boamefeild with 1a of aldercarr as they lie together between the highway leading to Coggeshall on the one side and a croft of land parcel of Procknotts on the other side and whereas at a court held 31.12.1651 it was presented by the homage that the said Thos upon 21.12.1651 aforesaid did surrender into the hands of the lord by the hands of Jonas Francklin instead of the bailiff and in the presence of Edw Elliston gentleman and Xoph Matthew two customary tenants of the said manor the same witnessing the said crofts of land and premises and all his customary lands and tenements to the use of his last will and whereas at a court held for the said manor upon 3.11.1652 it was presented that the said Thos Hales was dead now at this court came Thos Hales one of the sons of the said Thos Hales deceased and showed forth the last will and testament of the said Thos Hales duly proved and bearing date 29.11.1651 by which the said Thos Hales the father did give the said croft of land and of aldercarr and premises to the said Thos Hales the son and his heirs by the name of all those several parcels of copyhold lands belonging to the freehold tenement as they were given unto him by Thos Hales his father deceased upon certain conditions in the said will mentioned as in and by the said will it doth and may more at large appear and thereupon the said Thos Hales humbly prayed to be admitted tenant to the said premises to whom the lord of the said manor by his said steward did grant and deliver thereof seisin by the rod to have and to hold the said lands and premises with their appurtenances to the said Thos his heirs and assigns upon the conditions in the said will mentioned of the lord by the rod at the will of the lord according to the custom of the said manor by the rents services and custom s due and he gave to the lord for his fine but his fealty is respited because he is within age
Hales to Bomefeild etc and because the said Thos is within age that is to say of the age of 10yrs or thereabouts the custody of the body of the said Thos and of the tenements aforesaid is granted to Rose Hales widow mother of the said Thos and the lord by his said steward did deliver to her possession thereof by the rod to have the same to the said Rose and her assigns until the said Thos shall attain his age of twenty one years according to the tenor of the said last will of the said Thos Hales deceased and to the intents in the said will mentioned to hold of the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services due and she gave to the lord for a fine
