conditional surrender of Robt Knight and Alice his wife to the use of Jas Day | at this court it was presented by the homage that Robt Knight and Alice his wife customary tenants of the aforesaid manor in right of Alice herself after the last court viz 1.3.1661 came before the aforesaid Jn Joscelyne steward of the aforesaid manor at Colchester and Alice herself first by the steward solely and secretly examined as is the custom and consenting the aforesaid Robt and Alice by the rod surrendered by the hands of the lord by the hands of his aforesaid steward all that parcel of land called Kings Garden containing by estimation 1a with appurtenances lying in White Colne and then in the tenure and occupation of Jas Day to the use and behoof of the said Jas Day his heirs and assigns forever upon the condition that if the aforesaid Robt and Alice or either of them their heirs executors or assigns or any of them should pay or cause to be paid to the aforesaid Jas his executors or assigns at the now dwelling house of the said Jas in Earls Colne 26li10s that then the aforesaid surrender should be void and of no force |
