at a court held 30.4.1717 it appeared that Eliz Toller of Earls Colne widow on 2.5.1716 surrendered by the hands of Solomon Grimston deputy steward one messuage and garden adjoining called Oldhall one garden called Sagis Garden one other garden called Juds Garden and one parcel of garden containing in length 6rod and in breadth 4rod lying between a garden called Pruds on one part and lands belonging to the priory of Colne on the other part and one parcel of land parcel of a croft called St Mary Croft and containing in length 18rod2ft of assize to the east and 1rod2ft to the west all which messuage and gardens were then in the tenure of Thos Piper or his assigns to the several uses hereafter mentioned viz to the use of the said Eliz and her heirs until the intended marriage between Jn Bell of Witham linen draper and Thomasine Toller spinster youngest daughter of the said Eliz is solemnised and after the solemnisation to the use of the said Eliz for life and after her death to the use of Thomasine for her life and after her death to the use of Jn Bell for his life and after the death of them and the survivor to the use to the issue of the bodies of Jn Bell and Thomasine between them legitimately procreated according of the last will of the said Eliz or any writing under her hand and for defect of such writings to the legitimate issue of Jn and Thomasine and for defect of issue to the use of the right heirs of the said Thomasine forever and at this court it appeared that the said Eliz died after the last court and that the marriage had been solemnised and at this court Thomasine Bell was admitted etc and gave fine
