also at this court found that Sam Burton of Cambridge grocer on 14.8.last did surrender by the hands of Sam Parkinson instead of the bailiff in the presence of Jn Newton and Jn Hatch gents all that his reversion expectant on the death of Eliz Burton his mother of all that messuage or tenement with appurtenances formerly Wm Waite's to the only use of Thos Newton of White Colne gentleman upon condition that whereas the said Sam Burton by his bond dated 2.8.1728 was bound in the penal sum of 200li to Thos Bridge then of Coggeshall gentleman since deceased for the payment of the sum of 100li unto the said Thos Bridge his executors etc on 1.10.1728 which condition was not performed and whereas the said Thos by his last will appointed the said Thos Newton one of his executors who proved the said will and took upon himself the sole execution and burden thereof and the said Sam Burton intends this surrender as a further and corroborating security of the said sum of 100li that if the said Sam Burton his heirs or assigns shall truly pay unto the said Thos Newton his executors etc the sum of 100li with interest now due and to grow due in or upon 3.8.1746 then to be void otherwise in full force subject to the payment of 46li with interest etc to Rich Wale of Earls Colne gentleman to whom the said premises were surrendered 10.1.1743 by the said Sam Burton and the said Eliz Burton his mother for the payment of 47li3s on 11.7.next
