it is shown by the homage that Geo Chatterton out of court and after the last court surrendered into the hands of the lord by the hands of Jn Estey instead of the bailiff in the presence of Thos Roote tenant of the lord the same testifying one cottage with garden adjoining and the appurtenances being and lying in Earls Colne Church St called Ballards as etc to the use and behoof of Geo Chatterton his son aged 3yrs and more his heirs and assigns provided always that if it should happen that the said Geo should die without living heirs Edith his mother late wife of the said Geo Chatterton the father should have the remainder of the aforesaid cottage with appurtenances and to her heirs according to the form and effect of the last will of the said Geo deceased who the same said Geo the son by Rich Siday husband of the aforesaid Edith mother of the said Geo came and sought admittance thereof and because thus it was shown by the homage therefore he was admitted thereof tenant of the lord to whom by the steward the lord delivered thereof seisin into the hands of his attorney to hold for himself his heirs and assigns from the lord by the rod etc and in default of such issue the remainder thereof as stated above and because the said Geo is under age as stated above therefore custody both of the body of the said Geo and the tenement and garden were committed to the aforesaid attorney to hold for himself during the minority of the same said Geo from the lord by the rod etc and he gave to the lord the fine for having such custody thereof of the said Geo until he should reach his full age as stated above and fealty was respited
