whereas at a court here held monday being 12.4.1602 Wm Smithe was admitted tenant of the lord for himself and his heirs to one parcel of waste field of this manor upon which one cottage was built containing in length 7p and in breadth 2p one head thereof abutting towards the north the other head thereof abutting towards the south and lying between the land of Heyhouse on one part towards the east and the kings highway leading from Colne as far as Colne Park on the other part towards the west according as by copy of court roll brought to this court and clearly shown now at this court it is shown by the homage that out of this court and after the last court the said Wm Smithe surrendered into the hands of the lord by the hands of Jn Potter instead of the bailiff in the presence of Robt Reade and Wm Catte customary tenants the same testifying according to the custom of the said manor the said parcel of waste field with the cottage built upon it to the use and behoof of Thos Prior and Agnes his wife and the heirs and assigns of Agnes herself forever who the same Thos and Agnes present here is court sought thereof admittance for themselves to whom the lord by his said steward granted thereof seisin to have to the same Thos and Agnes and the heirs of Agnes herself forever to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services thereunto belonging and by right accustomed and they gave to the lord their fine as is shown in the margin and made fealty to the lord and were admitted thereof tenants of the lord etc
