whereas at a court here held friday being 2.10.1607 Edw Potter was admitted tenant of the lord for himself and his heirs to one parcel of land sometime of the lords waste situated upon Colneford Hill upon which Wm Swattocke lately built one swinesty containing in length 13ft and breadth 12ft according as etc now at this court it is shown by the homage that the said Edw Potter out of this court and after the last court surrendered the said parcel of land with appurtenances into the hands of the lord by the hands of Jn Knight instead of the bailiff in the presence of Wm Catte and Thos Smith customary tenants of the lord the same testifying according to the custom of the said manor to the use and be hoof of Jas Burton and his heirs upon the condition that if the said Jas Burton his heirs executors of assigns should pay or cause to be paid to the aforesaid Edw Potter his heirs executors or assigns the sum of 4li now and in the following form viz 20s on the day of the said surrender and the other 20s upon the feast of the annunciation next following the date of the said surrender and the other 40s of the said remaining sum of 4li upon the feast of michaelmas 29.9.1609 then the said surrender in all its force should remain in effect otherwise it should be completely in vain and null and void in law upon which now to this court came the said Jas Burton and sought admittance from the lord for himself thereof upon the said condition to whom the lord by his said steward granted seisin thereof to have to the said Jas Burton and his heirs upon the said condition to hold from the lord by the rod at the will of the lord according to the custom of the said manor by the rents and services thereunto belonging and by right accustomed and he gave to the lord his fine as is shown in the margin and he made fealty to the lord and was admitted thereof tenant of the lord
